Amber Heard has filed a motion to appeal the ruling from her defamation trial with ex-husband Johnny Depp that awarded her former spouse $10.4 million in damages.
Details from Depp and Heard’s marriage, which spanned from 2015 to 2017, came out in a highly publicized, six-week trial, which involved graphic testimony from both parties.
On Thursday, Heard, 36, submitted the notice of appeal to the Circuit Court of Fairfax County where the trial was held in Virginia in May.
In a statement shared with TODAY, a spokesperson for Heard said, “We believe the court made errors that prevented a just and fair verdict consistent with the First Amendment. We are therefore appealing the verdict.”
The statement concluded, “While we realize today’s filing will ignite the Twitter bonfires, there are steps we need to take to ensure both fairness and justice.”
The appeal echoes a sentiment Heard said in a statement issued after the verdict was read on June 1: “I’m sad I lost this case. But I am sadder still that I seem to have lost a right I thought I had as an American — to speak freely and openly.”
Depp’s legal team issued a response after Heard’s appeal filing.
“The jury listened to the extensive evidence presented during the six-week trial and came to a clear and unanimous verdict that the defendant herself defamed Mr. Depp, in multiple instances,” a spokesperson for Depp wrote in a statement shared with TODAY. “We remain confident in our case and that this verdict will stand.”
Depp had sued Heard for $50 million over an op-ed she wrote for the Washington Post in 2018 where she described herself as “public figure representing domestic abuse.”
Despite Depp not being named in the article, his legal team argued in a complaint filed in 2019 that it was a “clear implication that Mr. Depp is a domestic abuser.” Depp denied all allegations of abuse.
Heard then countersued for $100 million after claiming Depp and his legal team defamed her by orchestrating a “smear campaign” to try to discredit her allegations, per the official complaint.
In June 2022, the jury unanimously decided that there was “clear and convincing evidence” indicating Heard acted with “actual malice” when she penned the op-ed, per court documents.
Depp was awarded $10 million in compensatory damages for jobs and opportunities lost and $5 million in punitive damages, per NBC News.
Fairfax County Circuit Court Judge Penney Azcarate reduced the punitive damages to $350,000, which is the state’s statutory cap or legal limit, making Depp’s total damages amount to $10.4 million, per court documents.
The jury also found one of Heard’s defamatory statements to be true and awarded her $2 million in damages as well.
A few weeks after the verdict, Heard gave an exclusive interview with TODAY’S Savannah Guthrie as part of a “Dateline” special.
The “Aquaman” actor also said that she would not recant any of her allegations of physical and psychological abuse, which was part of her testimony. “To my dying day (I) will stand by every word of my testimony,” she said.
On July 9, Heard’s legal team filed paperwork to request a mistrial, according to NBC News, saying that the wrong juror was seated during the defamation trial. Heard’s request for a mistrial was denied on July 13 by Judge Penney Azcarate, per E! News, who said in court documents she found “no evidence of fraud or wrongdoing.”
During an appearance on TODAY after the trial concluded, Heard’s lawyer, Elaine Charlson Bredehoft, told Savannah Guthrie she believed her client was “demonized,” and that public support for Depp rendered the trial “lopsided.”
“There’s no way (the jury) couldn’t have been influenced by it, and it was horrible,” she said. “It really, really was lopsided.” Bredehoft also told TODAY that Heard is “absolutely not” able to pay that much in damages to Depp.
After the verdict was read on June 1, Depp said in a statement given to TODAY that he was “at peace,” and that the jury had given him his “life back.”

Newly married Ben and Jen were spotted boarding a private jet a day prior in Los Angeles, along with their kids. There was no word on where the couple was headed, but New York was evidently the destination — and possibly where the couple plants to celebrate Ben’s milestone 50th. Notably, The Town actor hails from nearby Boston, MA — so it’s also plausible that the duo could head north to mark the occasion with his mother Chris.
Ben and Jen shocked the world just over a month ago when they legally married in a Las Vegas, Nevada ceremony on July 16. They were joined by just her child Emme, 14, and his daughter Seraphina, 13, as witness for the intimate affair, where Jen wore a vintage dress from “an old movie” (believed to be Jersey Girl with Ben, which came out after their 2004 split), per her On The JLo newsletter.
The Maid In Manhattan star also recently had a birthday last month, which the couple celebrated in Paris alongside kids Violet, 15, Seraphina, and Samuel, 10, as well as her twins Emme and Max, 14. Ben and Jen first stopped by the Monsieur Dior restaurant inside the flagship Dior store at 30 Montaigne Ave., where she turned heads in a hot pink Reformation dress with a midi-length cut. The beginning of the end! After six years at Netflix, Stranger Things is getting ready to wrap up its journey with a fifth and final season.
Ahead of the show’s highly-anticipated season 4 premiere, creators Matt and Ross Duffer announced that they were going to end the series after one more chapter in Hawkins, Indiana.
“Seven years ago, we planned out the complete story arc for Stranger Things,” they detailed in an open letter in February 2022. “At the time, we predicted the story would last four to five seasons. It proved too large to tell in four but — as you’ll see for yourselves — we are now hurtling toward our finale. Season 4 will be the penultimate season; season 5 will be the last.”
The writing team hinted that they were planning to expand the Stranger Things universe with more projects. “There are still many more exciting stories to tell within the world of Stranger Things: new mysteries, new adventures, new unexpected heroes,” the message concluded. “But first, we hope that you stay with us as we finish this tale of a powerful girl named Eleven and her brave friends, of a broken police chief and a ferocious mom, of a small town called Hawkins and an alternate dimension known only as the Upside Down.”
Later that year, the Duffer Brothers opened up about their vision for the final episodes and addressed the season 4 episode split.
“The original plan was to release it all at once again. But as we began turning over episodes, everyone began to feel the season was too big to be released in one batch — at nearly 13 hours, it is really more two seasons than one,” they told Variety in May 2022 after Volume 1 dropped the first seven episodes. “Episode 7 is as big as any season finale we’ve ever had, so it made sense to everyone involved to split the season there. Episode 7 really serves as the end of the second act — and we feel that our final act had enough meat on the bone to make up Volume 2.”
As fans prepared for Volume 2 of season 4, Ross and Matt revealed that they were hoping the final season wouldn’t have such a long wait. “We always knew that Season 4 was going to be the penultimate season, and that its ending would dive directly into Season 5. During the six-month pandemic hiatus, we outlined Season 5 and pitched it to Netflix,” they shared at the time. “Don’t hold us to it, but the gap should be quite a bit shorter this time, due to the fact that we already have an initial outline, and we can’t imagine there will be another six-month forced hiatus.”
